John Hickey aged 68 is accused of dangerous driving causing death.
A man has been sent for trial in connection with a road death in Offaly last year.
John Hickey, aged 68 and with an address at Beechlawn, Killane, Edenderry, is accused of dangerous driving causing the death of Anthony Leavy at Clonmeen, Rhode on June 14 last year.
A book of evidence was served when Mr Hickey came before Tullamore District Court yesterday and he was remanded on continuing bail to Tullamore Circuit Court on February 25.
Applying for legal aid, defence counsel Richard Wixted said the accused was in quite a complicated and desperate financial situation and was facing a very serious charge.
He said his mortgage arrears were large and his outgoings were very high and though he was earning €1,500 a week he is left with nothing when he makes his repayments.
Judge Catherine Staines said she would need more information about how his mortgage arrears were allowed to get into that situation and she considered reserving her decision on granting legal aid.
Mr Wixted told her that the charge facing the accused was extremely serious and on that ground he would qualify for aid.
Judge Staines granted legal aid, saying Mr Hickey could be represented by a senior and a junior counsel.
The accused had been granted bail at a previous court appearance on December 18.
