Enoch Burke's appeal against his dismissal from Wilson's Hospital School in Westmeath won't go ahead tomorrow as planned.
The hearing was due to take place in the morning, but the High Court has granted him a temporary injunction in light of his concerns over the makeup of the panel.
Last January, Enoch Burke was dismissed from his teaching role at Wilson’s Hospital School following a Stage 4 disciplinary process, which was initiated as a result of his behaviour after being told of a transitioning student’s desire to be referred to by a new name and gender-neutral pronouns.
A Disciplinary Appeal Panel was due to meet tomorrow to hear Enoch’s challenge to his dismissal, but earlier this week he raised concerns about the impartiality of some of its members, as well as issues around the disclosure of certain material, including WhatsApp exchanges between his former principal and the Chairperson of the Board of Management; and today he successfully applied for a temporary injunction to stop the hearing from going ahead.
The matter will come back before the court next week.
