Justice Brian Cregan made the order for Mr Burke's Mother Martina and Sister Ammi to appear in court tomorrow after a hearing last week was suspended following persistent interruptions from the family.
Last week's case was in relation the teacher's latest action against a panel tasked with assessing his dismissal from Wilson's Hospital School in Westmeath.
His appeal was struck out, and Judge Cregan will rule on costs for the case as well as the contempt question tomorrow.
