The hearing between Wilson's Hospital School and Enoch Burke has yet to get under way because of an issue raised by Mr Burke in relation to an alleged "tampering" of material.
The case relates to the disciplinary process that led to him being dismissed from his teaching role at the Westmeath school for gross misconduct.
After hearing from both sides in relation to the alleged tampering, the judge described Enoch's arguments as "flimsy" and decided there was no evidence to support his claim.
Due to his failure to accept the ruling of the court, the judge has given Enoch a formal warning that he is in contempt of court and threatened to have him removed if he didn't behave.
It's not yet clear if the 4-day hearing will get under way today.
