Judge Bernadette Owens says the case is in danger of being struck out.
Gardaí are racing against time to ensure a case against a man alleged to have attacked another man in a Midlands town goes ahead.
The Irish Independent is reporting 26 year old Joel Jacob of Ashurst Apartments, Mount Merrion, Blackrock, Dublin is accused of assault causing harm on Mullingar's Oliver Plunkett Street in August in 2023.
After Judge Bernadette Owens queried the State's evidence around the alleged injuries, Sergeant Paul McNally told the court they were relying on a summary of evidence collected by prosecuting gardaí.
Judge Owen's wants the State to verify the alleged victim's statement with Gardaí requesting an adjournment until March to allow them to follow up.
The case will return to Mullingar District Court on March 4th when, if the doubts around the evidence remain unresolved, the case will be at risk of being struck out.
