The judge who heard the case against Carlow gunman Evan Fitzgerald says he did not have the power to oppose his bail.
Desmond Zaidan, presiding at Naas Distric Court, says there's been a lot of misinformation in relation to the case - and that Gardaí had consented to the 22 year old receiving bail.
The comments follow the death of the 22 year old after he opened fire in the Fairgreen Shopping Centre in Carlow Town on Sunday.
He died from self-inflicted injuries in the incident, while a young girl was treated at the scene for minor injuries.
Mr Fitzgerald had been due in court today to face a number of guns, ammunition and explosive charges.
