The Enterprise Minister is bringing the measure to Cabinet today.
The referendum on the Unified Patent Court, which was planned for June, looks likely to be postponed.
The poll was set to be held alongside the local and European elections.
Government sources have previously said there was not enough time to explain and campaign for the patent court.
On his way into Cabinet this morning, Enterprise Minister and Longford Westmeath TD Peter Burke said the referendum could be pushed back:
