A Laois man and his newly married wife have withdrawn damages claims worth 120 thousand euro after a honeymoon photo album on Facebook proved their downfall.
22 year old Arthur McInerney of Highfield Meadows, in Portlaoise and 21 year old Mary Marie McCarthy of Cabra Grove, Holycross Road, Thurles, Tipperary had claimed they were injured when a Bentley limousine taking them to Dublin Airport had been struck by another car on a roundabout near Swords in Dublin.
The couple told the judge they got married on November 11, 2022, hours before the collision happened. They had been able to continue their journey and catch their flight to Tenerife.
The Irish Independent is reporting they sued Armands Vilcins, of The Oaks, Rockfield, Dundrum, Dublin 16, whose car had collided with the Bentley. Mr McInerney complained of a back injury, while Ms McCarthy alleged she had injured her forehead when it slammed against a window.
Vilcin's insurers conceded liability in the case, which was being defended on the basis of a minimal impact collision incapable of causing the injuries.
Both plaintiffs, when confronted with pictures of them apparently enjoying their honeymoon on waterslides and a four-wheel drive safari, told the court they had used over-the-counter pain killers to help them "make the best of the holiday".
When the judge remarked that in the photo taken on the first night of their honeymoon there was no sign of a mark to her forehead, Ms McCarthy said she had covered it up.
The insurers' solicitor then told Mr McInerney he had felt well enough very shortly after returning from honeymoon to have climbed Croagh Patrick, a snapshot of which had also been posted online.
Following a brief adjournment, both legal teams returned to inform the judge the two claims had been withdrawn and could be struck out.
The defendant decided against seeking legal costs against the couple.
