Mr Burke was transferred to Castlerea Prison on March 1st.
Enoch Burke has told the High Court it was unlawful for him to be moved to Castlerea Prison.
The former schoolteacher at Wilson's Hospital School in Westmeath, had been detained in Mountjoy Prison since he was found in contempt of court at the start of the year, but was moved to the Roscommon location on the 1st of March.
Mr Burke is arguing this transfer has no basis in law and is in breach of a court order issued on the 19th of January.
The matter has been adjourned to Thursday, when the court will a hear a legal submission from the governor of Mountjoy Prison.
