Mr Burke has challenged the Disciplinary Appeals Panel over alleged unfair procedures.
The long running Enoch Burke saga looks set to be extended significantly after members of a panel due to issue its recommendation on his dismissal from a Westmeath school have resigned.
The anti-transgender teacher has already taken action against the Disciplinary Appeals Panel claiming he was denied fair procedures at a hearing in December.
A hearing on that action is due to take place today but it now appears the judgement on that case will have no bearing as the panel will no longer continue to work to deliver a recommendation.
Mr Burke was dismissed from Wilson's Hospital School after a number of public confrontations with the school's principal after it had asked a student be referred to by their preferred pronouns.
