Mr Burke is seeking to make an application to stop the inquiry from going ahead.
Former teacher Enoch Burke will be back before the High Court next week in advance of a Teaching Council inquiry into his presence at a Westmeath school.
Mr Burke has spend close to 700 days in prison since 2022 for breaching court orders to stay away from Wilson's Hospital School where was suspended from and subsequently dismissed from.
Justice Brian Cregan made an order today for him to be produced from Castlerea Prison on Monday to allow him to make an application to stop the inquiry from going ahead.
It follows an application for the order by Mr Burke's brother Isaac.
After numerous delays, objections, and appeals he was dismissed from the school last month.
