Mr Burke is being granted permission to apply for an injunction against the Disciplinary Appeals Board.
Enoch Burke is heading back to the court on Thursday after the High Court granted him permission to apply for an injunction to prevent an appeals panel from giving their recommendation to a Westmeath School.
The Disciplinary Appeals Board is currently due to meet on Saturday to consider Mr Burke's appeal against a decision to dismiss him from Wilson's Hospital School.
He believes the panel hearings have been devoid of "any sense of natural justice and fair procedures".
The history and German teacher wants a new panel without any of the current panel members included, according to the Irish Examiner.
