Enoch Burke will appear before a fitness-to-teach inquiry tomorrow, after withdrawing a High Court application aimed at stopping the hearing from going ahead.
The jailed schoolteacher had sought an injunction against the Teaching Council.
Enoch Burke had been seeking an interim injunction to stop tomorrow’s fitness-to-teach inquiry from proceeding.
The application was brought against three members of the Teaching Council panel due to hear the case.
But in the High Court today, Mr Burke was told he could instead seek the recusal of those panel members at the beginning of the inquiry tomorrow.
The judge said any such application would be considered by the Teaching Council before the hearing begins.
The court also heard that no evidence in the fitness-to-teach case will be heard this week.
Mr Burke then withdrew his injunction application and is expected to appear before the inquiry tomorrow.
