A laois council are opposed to the project based on a number of concerns.
The future of plans for nearly 100 homes in the midlands are on hold, after the application was appealed to An Bord Pleanala.
JC Brenco Developments received planning permission from Laois County Council for the construction of 99 houses in Rahin, Ballylinan, last month.
The development, which also includes the provision of a creche, was appealed to An Bord Pleanala by the Ballylinan Council.
In a submission to Laois County Council, it raised concerns the construction of 99 homes in the area would lead to problems with the current infrastructure of water, wastewater and roads provision.
It also claims the local school has no room to expand further to accommodate the additional pupils which could be introduced as a result of the development.
The case was lodged with ABP last week, which is due to make a final decision on the project by the 15th of July.
