The schoolteacher has so far spent 513 days in prison.
An order has been made for Enoch Burke to be arrested and sent back to prison.
It comes after yet another application for him to be imprisoned was brought by Wilson’s Hospital School for his continued breach of a court order to stay away.
In the opening line of his judgement, Mr J Brian Cregan said this case involves, “the most deliberate, sustained and concerted attack” by Enoch Burke, and other members of his family, on the authority of the civil courts and the rule of law.
He said this case is “not about transgenderism,” as claimed by Enoch Burke.
He said he was dismissed from his position at Wilson’s Hospital School for gross misconduct, and has been imprisoned, and fined, for contempt of court, because he has breached court orders directing him not to trespass on school property.
By continuing to show up at the school, he said Mr Burke is clearly still in “deliberate and persistent contempt” of the order.
An order to send him back to prison was then made in his absence.
Mr J Cregan was also satisfied there was a case to answer in terms of potential criminal proceedings for contempt of court in relation to Enoch, his brother, Isaac, sister, Ammi, and mother, Martina, for their alleged conduct throughout this case.
