Mr Burke has spent more than 500 days in prison.
A decision on Enoch Burke's dismissal from a Westmeath school will be made this weekend.
A disciplinary appeal panel is meeting on Saturday in an undisclosed location in Athlone for a hearing.
If the board decide against Mr Burke, his dismissal for gross misconduct will be confirmed.
The judge who approved his most recent stint behind bars refused his application to amend certain language he used in his judgement.
