Enoch Burke is due in court tomorrow.
A Westmeath school's board of management wants to be joined as a notice party in Enoch Burke's lastest High Court appeal.
The History and German teacher is back in court tomorrow in relation to his lastest action against a panel tasked with assessing his dismissal from Wilson's Hospital School.
Mr Burke has already been successful with one challenge against a previous version of the panel based on his concern the case would be treated with bias by one of its members.
He called ASTI General Secretary Kiearan Christie an "activist for transgenderism".
He then appealed against a new panel after claiming one of its members ASTI President Geraldine O'Brien was also biased.
Two thirds of that panel, excluding Ms O'Brien, then resigned.
It's understood the school's board believes its involvement in forming the next panel could help resolve the litigation in a way that would satisfy Mr Burke and protect his rights.
The board also wants members of the Teacher's Union of Ireland considered.
The application is expected to be considered when Mr Burke returns to court tomorrow.
