Justice Brian Cregan is rejecting Mr Burke's claims of 'untrue' language in his judgement.
The judge who approved Enoch Burke’s most recent stint behind bars has refused Mr Burke’s application to amend certain language he used in his judgement.
According to Mr Burke, the judge’s use of words like, "baleful, malign, roaming and stalking," amounted to character assassination.
Enoch Burke claimed the judgement underpinning the decision to send him back to prison for contempt contained factual errors.
He also claimed that language used about him was untrue and unjustified and he applied for a number of paragraphs to be deleted.
Mr J Brian Cregan rejected that outright.
He said the language he used – including a description of Enoch Burke as a “baleful and malign presence” who “roams” the corridors of Wilson’s Hospital School – was carefully chosen and entirely justified based on the evidence.
He said Mr Burke continues to trespass on school property in deliberate defiance of court orders, and that his behaviour, marked by “verbal aggression, unregulated anger and a strategy of confrontation”, makes him a potential danger to teachers and pupils.
