Solicitors for the Cathaoirleach of the Municipal District have written to Mr. Smollen.
A dispute over publicity is now the subject of a legal letter between rival members of Offaly County Council.
It concerns a photo opportunity at Esker Hills Golf Club involving Ryder Cup star Shane Lowry to which local Councillor Ken Smollen says he was not invited.
Solicitors for the Cathaoirleach of the Municipal District have written to Mr. Smollen insisting Tony McCormack had no hand or part in organising the event, that he did not deserve comments made on social media and that he required an apology.
Councillor Smollen responded that he has neither the time nor funds to engage a legal team and apologised for hurting Councillor McCormack's feelings.
He maintains that people in Clara asked why he had not appeared in the picture.
