Court Of Appeal Reserve Judgement On Enoch Burke Case

They will judge at a later date if his suspension from Westmeath's Wilsons Hospital School was lawful.

The Court of Appeal has reserved judgement in Enoch Burke’s application for an extension of time to appeal one of the most significant judgements in his case.

  He is seeking to challenge a ruling that his suspension from Wilson’s Hospital School was lawful.

In 2023, Mr J Alex Owens ruled against Enoch Burke in relation to the lawfulness of his suspension from Wilson’s Hospital School.

He also made an order refraining Mr Burke from trespassing at the school – an order which has been defied countless times and led to his imprisonment for contempt.

Mr Burke didn’t appeal that judgement within the 28-day window but is now seeking an extension of time to bring such a challenge.

He claims the issue affects all teachers and schools nationally and laid out his reasons as to why he believes he is a strong case.

The school’s barrister, Rosemary Mallon SC, described his application as “extraordinary and unjustified.”

She described his grounds of appeal as “weak” and emphasised the school’s need for finality on the issue.

The court will deliver its judgement on a later date.

Separately, Mr Burke is seeking an injunction to put a stop to a planned disciplinary appeals hearing, which is due to take place later this week.
