Laois Wind farm developer Coolglass Wind Farm Ltd has been awarded 50% of its legal costs following a landmark Supreme Court challenge over climate law obligations.
The Irish Examiner is reporting, the seven judge panel upheld a High Court order overturning An Coimisiún Pleanála’s 2024 refusal of planning permission.
The court affirmed that climate obligations on public bodies are real, effective and, if necessary, enforceable, creating binding legal standards.
However, it noted the planning authority had prevailed on most grounds of appeal advanced by the developer.
Coolglass plans to build a 13 turbine wind farm at Timahoe, with the application now set to return to An Coimisiún Pleanála for reconsideration.
